Former nursing home CNA accused of choking a resident

FREEPORT (WREX) — A former CNA at a Stephenson County nursing home was arrested on Monday after being accused of attacking a 73-year-old resident earlier this year.

James Spann, 34, of Freeport, was taken into custody from his home on Monday after a warrant was issued for his arrest earlier in the day.

Freeport Police Detective Lt. Andrew Schroeder says Spann is charged with official misconduct and aggravated battery to a senior citizen. Spann put the resident in a chokehold and a headlock, according to Schroeder.

Spann used to be a certified nursing assistant at Walnut Acres, formerly known as the Stephenson County Nursing Center, located at 2946 S. Walnut Rd.

Schroeder says the incident happened on April 6th, but wasn’t reported to police until April 16th. Schroeder says the nursing home reported it to the state and an inspector came out to investigate. The inspector conducted an investigation, and then turned it over to police.

After police conducted their investigation, the case was turned over to the Stephenson County State’s Attorney Carl Larson, who also represents the county-run nursing home. Due to a conflict of interest, Larson turned the case over the Attorney’s General’s office on May 3, according to Schroeder.

Schroeder says once the Attorney General’s office filed the charges, Freeport Police arrested Spann.

He was taken to the Stephenson County Jail where his bail was set at $10,000.
